About this issue
Federal criminal-justice and policing policy spans the federal criminal code, sentencing law administered by the U.S. Sentencing Commission, the Bureau of Prisons, and Department of Justice grant programs that fund state and local law enforcement. Active congressional debate focuses on the First Step Act's implementation, federal sentencing for drug and firearms offenses, qualified immunity for officers, body-camera and use-of-force standards, federal hate-crime law, fentanyl scheduling, juvenile-justice grants, civil asset forfeiture, and reentry and expungement programs. Supporters of further reform argue the system over-incarcerates and disproportionately harms Black and Latino communities; supporters of stricter enforcement argue rising violent-crime concerns require robust prosecution and visible police support. State and local agencies handle the vast majority of policing in the United States, so federal policy operates largely through grant conditions, statutory minimums, and consent decrees.
