About this issue
Federal trade policy is set jointly by Congress, which has constitutional authority over tariffs and commerce, and the executive branch, where the U.S. Trade Representative negotiates agreements and the Department of Commerce administers anti-dumping, countervailing-duty, and Section 232 national-security measures. Active congressional debate focuses on Section 301 tariffs on Chinese imports, USMCA implementation and review, trade-promotion authority, restrictions on outbound investment in sensitive sectors, the de minimis import threshold, Buy American procurement rules, agricultural export programs, and labor and environmental enforcement provisions in trade agreements. Supporters of more open trade argue lower barriers raise consumer welfare and strengthen alliances; supporters of more protective measures argue tariffs and industrial policy are needed to rebuild domestic manufacturing and counter unfair foreign practices. Export-control policy and CFIUS investment review are adjacent debates.
