Ebenezer Finley was born on July 31, 1833, in Orrville, Ohio, to William Finley and Rhoda Harris Finley. He spent his formative years in Orrville, where he received his education and engaged in a variety of occupations. Before entering the legal profession, Finley worked as a teacher in Illinois, a boatman on the Illinois and Mississippi Rivers, and a crew member on cargo ships operating on the Great Lakes. His diverse experiences contributed to a well-rounded perspective that would later inform his political career.

In February 1858, Finley married Charlotte E. Codding, with whom he had a son named Harry M. Finley. In 1859, he began studying law in Bucyrus, Ohio, under the guidance of his uncle, Stephen Ross Harris. Finley was admitted to the bar in 1861 and commenced his legal practice in Bucyrus shortly thereafter. His legal career was interrupted by the outbreak of the American Civil War, during which he enlisted in the Union Army. Finley served as a first lieutenant in Company K of the 64th Ohio Infantry Regiment. He participated in several significant battles, including the Battle of Shiloh. However, his military service was cut short due to an injury sustained in an accident, leading to his discharge from the army in September 1862.

Following the war, Finley returned to Bucyrus and resumed his legal practice. He became actively involved in veterans' organizations, such as the Grand Army of the Republic and the Society of the Army of the Cumberland. His commitment to public service extended to local governance, as he served as the mayor of Bucyrus from 1863 to 1865.
